The new Cabotage Regulations under the Merchant Shipping Act (Cap 389) have finally given legal teeth to the principle that our waters\u2014from the territorial sea to the Exclusive Economic Zone and continental shelf\u2014should be served primarily by Kenyan vessels. Regulation 6 of the 2025 draft affirms that &#8220;a Kenyan ship may engage in local trade within the cabotage area&#8221; if properly registered or licensed.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Add to this the National Blue Economy Strategy 2025\u20132030, which ambitiously targets KSh 350 billion in annual revenue and positions maritime transport as a cornerstone of our industrial future. The vision is bold. The legal framework is ready.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Yet there is a gaping hole in this otherwise impressive architecture: the near-total absence of affordable, long-term financing for vessel acquisition.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Without a dedicated Cabotage Vessel Financing Fund (CVFF), our regulatory ambitions will remain anchored in theory while foreign-flagged ships continue to dominate our trade lanes\u2014and carry away billions of shillings in freight payments annually.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>The Problem: A Regulatory Framework Without Vessels<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kenya&#8217;s cabotage rules are among the most progressive in the region. Regulation 7(1) mandates that &#8220;a Kenyan ship shall wholly be manned by Kenyan citizens.&#8221; Foreign participation is strictly limited to cases where no suitable Kenyan vessel is available, or where capacity shortfalls exist.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>But a law without vessels is a hollow instrument.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Local operators find themselves locked out of the very market they are meant to lead. Commercial banks view shipping as high-risk, with long asset lives and cyclical markets. The result? Our coastal and regional trade routes remain overwhelmingly reliant on foreign carriers, while Kenyan entrepreneurs watch from the shore.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">A CVFF would not merely level the playing field\u2014it would create the playing field itself.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Learning from Nigeria: Inspiration and Caution<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Nigeria&#8217;s experience offers both a blueprint and a warning.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The Coastal and Inland Shipping (Cabotage) Act No. 5 of 2003 established Nigeria&#8217;s CVFF with a clear mandate: &#8220;restrict the use of Foreign Vessels in Domestic Coastal Trade&#8221; and &#8220;promote the development of Indigenous Tonnage.&#8221; Over two decades, the fund has accumulated an estimated $700 million through a levy on cabotage contracts.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The potential is immense. The Nigerian model offers qualified applicants up to $25 million at single-digit interest rates over eight-year tenors, with projections of over 30,000 new jobs.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Yet here is the cautionary tale: as of August 2026, despite 92 applications and 12 Primary Lending Institutions, only one application had reached the approval stage. Bureaucratic inertia has held back a generation of shipowners.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kenya cannot afford a two-decade delay. Our fund must be operationalised from day one, with clear disbursement timelines, transparent eligibility criteria, and robust governance built into its constitutive instruments.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>What a Kenyan CVFF Should Look Like<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">A Kenyan CVFF should be structured as a revolving, ring-fenced facility, capitalised through three streams:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">1. A statutory levy on cabotage-related freight and charter activities, calibrated to Kenya&#8217;s trade volumes<\/div>\n<div dir=\"auto\">2. Government seed capital from the national budget or development finance<\/div>\n<div dir=\"auto\">3. Concessional lines of credit from multilateral institutions like the AfDB and the World Bank<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Disbursement terms should be commercially sustainable yet accessible:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00b7 Single-digit interest rates (6.5\u20138%)<\/div>\n<div dir=\"auto\">\u00b7 Tenors of up to ten years, with a moratorium period<\/div>\n<div dir=\"auto\">\u00b7 Borrower equity contribution of at least 15% to ensure risk alignment<\/div>\n<div dir=\"auto\">\u00b7 Per-applicant caps of $20\u201325 million to ensure broad-based participation<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Crucially, the fund must operate through approved banks with a 50\u201350 risk-sharing mechanism\u2014incentivising private sector participation while maintaining prudent underwriting.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Conditionality: Linking Finance to Cargo<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">This is where many such initiatives falter. A CVFF must not become a vehicle for asset speculation. Eligibility should require:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00b7 Demonstrated access to cargo contracts or long-term charter agreements (no vessel financed without a contract attached)<\/div>\n<div dir=\"auto\">\u00b7 Verifiable Kenyan ownership and beneficial control (Regulation 9(3))<\/div>\n<div dir=\"auto\">\u00b7 Compliance with manning requirements (Regulation 7(1))<\/div>\n<div dir=\"auto\">\u00b7 Adherence to IMO safety and environmental standards (Regulation 9(2)(e) and (f))<\/div>\n<div dir=\"auto\">\u00b7 Commitments to technology transfer and skills development<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">This cargo-linked financing model ensures that vessel acquisition is underwritten by identifiable revenue streams, reducing default risk and aligning the fund&#8217;s performance with broader trade objectives.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>The Strategic Imperative<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">For Kenya, a CVFF is far more than a financing tool\u2014it is a strategic lever for economic transformation.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Fleet growth. The fund would enable local operators to acquire modern vessels, supporting our growing shipyard capacity at Kenya Shipyards Limited and creating a virtuous cycle of construction, repair, and maintenance.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Value retention. Billions of shillings in freight payments currently leave our economy annually. A local fleet keeps that value at home.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Job creation. Cabotage regulations mean Kenyan crews on Kenyan ships. The fund would create cascading demand for seafarers, officers, technicians, and logistics professionals.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Regional integration. Under the AfCFTA and the Revised African Maritime Transport Charter (which Kenya has ratified), a CVFF would position Kenya as a regional hub for vessel ownership and chartering\u2014enabling Kenyan-flagged vessels to compete for regional cargoes under reciprocal arrangements.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Credibility. As Kenya prepares to host the 11th Our Ocean Conference and mobilise over USD 10 billion in blue economy investments, a functioning CVFF would signal that our commitments are backed by capital, not just communiqu\u00e9s.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>The Legal Foundation<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The legal architecture is already in place. The object of the Cabotage Regulations\u2014as explicitly stated in Regulation 4 of the 2025 draft\u2014is to:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00b7 &#8220;promote a viable shipping industry that contributes to the broader Kenyan economy&#8221;<\/div>\n<div dir=\"auto\">\u00b7 &#8220;facilitate the long-term growth of the Kenyan shipping industry&#8221;<\/div>\n<div dir=\"auto\">\u00b7 &#8220;maximise the use of ships licensed or registered in Kenya in local trade&#8221;<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The National Blue Economy Strategy 2025\u20132030, under Pillar 4, addresses &#8220;strengthened governance and financing&#8221; and &#8220;sustainable financing mechanisms.&#8221;<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The Maritime Laws (Amendment) Bill makes reference to &#8220;the establishment of a maritime cluster fund to promote the local shipping industry.&#8221;<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">What is missing is the political will and administrative efficiency to bring it all together.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>The Path Forward<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The time for deliberation is over. The imperative is action.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">A Kenyan CVFF, financed through a maritime levy and government seed capital, would signal a definitive shift from regulatory promise to economic reality. It would empower Kenyan seafarers, retain billions in freight payments within our economy, and solidify our position as a regional maritime hub.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The regulations are written. The strategy is laid out. The regional precedents\u2014both positive and cautionary\u2014are documented.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The only missing piece is the capital to bring it all to life.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Let us not allow Kenya&#8217;s blue economy to remain a slogan when it could so readily become a legacy.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong><em>Andrew Mwangura is a maritime analyst and commentator on African shipping and blue economy affairs.
